Mode Subscription Addendum
THIS MODE SUBSCRIPTION ADDENDUM (“ADDENDUM”) APPLIES TO ALL PURCHASES OF THOUGHTSPOT MODE PRODUCTS (COLLECTIVELY the “MODE SERVICE”), AND ADDS ITS TERMS TO THE BINDING ORDER FORM OR AGREEMENT INTO WHICH THIS ADDENDUM IS INCORPORATED BY REFERENCE (“AGREEMENT”) BETWEEN YOU INDIVIDUALLY OR THE BUSINESS ENTITY OR PUBLIC AGENCY ON WHOSE BEHALF YOU ARE ACCEPTING THIS AGREEMENT (“CUSTOMER”) AND THOUGHTSPOT, INC. (“THOUGHTSPOT”). Any references in the Agreement to “ThoughtSpot Cloud” will mean the “Mode Service” for the purposes of this Addendum. If Customer registers for the Studio version or other free trial or evaluation version of the Mode Service, the Evaluation Subscription provisions of Section 2.4 of the Agreement will govern that use.
In the event of any conflict between the terms of this Addendum and the Agreement, this Addendum shall govern to the extent of such conflict.
- Administrative Information. Administrative Information does not mean or include any data that is generated automatically by the Mode Service concerning Customer’s use of the Mode Service (the “Meta-data”). Such Meta-data may include, but is not limited to, information concerning the number of reports run by the customer, report run times, and the identity of the person that ran a report.
- Technical Support. Notwithstanding anything to the contrary in the Agreement, Section 3.3 (Support and Security) of the Agreement shall not apply to the Mode Service. ThoughtSpot will provide the Mode Service technical support by email and a chat application Monday through Friday (excluding U.S. federal holidays and other days when ThoughtSpot’s offices are closed) during the hours of 5 a.m. to 6 p.m. Pacific Time, to assist in Customer’s access to and use of the Mode Service. Customer may contact support for the Mode Service by email at [email protected]. ThoughtSpot will respond to and complete any necessary technical repairs within a commercially reasonable amount of time.
